The 2020 Election Will Put Our Constitution to the Ultimate Test
2020 is proving to be one of the most tumultuous years in our Nation’s history. A perfect storm has formed that will challenge the very fabric of our democracy. Our shores are being pounded by what appears to be a never ending pandemic, a widening chasm in our political ideologies, increasing inequality in race relations, continued wealth disparity, and an upcoming election crisis that has been forming. Our system of checks and balances is undergoing a vigorous stress test that will push our society to the brink of civil unrest and will test the founding principles of our Constitution.
But I don’t want to focus on what is wrong, but rather on how what is wrong can expose what is right and lead towards a path of transformation that could propel America into a new age of prosperity. Despite trying very hard not to sound idealistic, I do believe in the idea of silver linings. In 2016, the result of the Presidential election presented one such silver lining. It exposed both the vulnerability and the importance of our elections. No matter which side of the aisle you were on, it reminded each of us of the importance of civic engagement. I knew then that complacency and apathy regarding voting would be dramatically challenged. Trump’s election was a wake up call for America regardless of whom you voted for. I knew then that the net, net would be an increase in voter participation which is a good thing for any healthy democracy to remain strong and vibrant.[/vc_column_text][vc_empty_space height=”21px”][vc_column_text]

[/vc_column_text][vc_empty_space height=”35px”][vc_column_text]The next 90 days leading up to January 20, 2021 will be the ultimate test of our Democracy. While the politicking and engagement of both parties will be at a fever pitch, so too will be the efforts of the legal community as it searches for vulnerabilities in The Constitution that our forefathers simply could have not foreseen. If one accepts that no person is perfect, then one can surmise that our Constitution, a product of human design, is not perfect. Benjamin Franklin could not have predicted the development of social media, nor could Alexander Hamilton have imagined a monetary policy cut loose from the gold standard. So naturally, as humankind and by definition society, continues to evolve so should the laws that govern us. This year’s elections will expose the weak points of our founding ideals. Our rules of law will be challenged, but will our Constitution stand the stress test? One can only hope the connective tissue that keeps our democracy functioning will not prove to be our Nation’s Achilles heel.

No matter what your political ideology may be, this election will undoubtedly expose the weaknesses in our structure of government and our laws. This in turn should focus the electorate’s attention towards addressing and shoring up the very vulnerabilities that will come to the surface in the days to come. It is imperative that the leaders we choose to direct our Nation take the necessary steps to repair any damage to our governing norms and amend those aspects of The Constitution that need addressing. Amendments to the constitution are not easy, but they are absolutely necessary if as a people and a society we want to continue to evolve. This will make the Supreme Court more important than ever before and given the recent additions to the bench, a critical tipping point.
Buckle up America…it’s going to be a bumpy ride before we reach cruising altitude.
